This article is a basic criminal policy discussion on behaviors occurring in a virtual space called the metaverse. In the metaverse, ‘meta’ means virtual space and has a different dimension from the real space, so in order to apply real criminal norms to ‘virtual behavior’ in the metaverse, it must be able to transcend the dimension. Regarding the problem of how the reality norm can be applied to the metaverse beyond the dimension, this article seeks to infer some legal principles that already exist in the reality norm. And as a method for the ultimate solution, we would like to actively extend the personal right of the reality norm to a specific cyberspace such as the metaverse and use it as the basis for ‘act’ and ‘legal interest’. In other words, I would like to propose a way to introduce the concept of the so-called ‘cyber personality right’. If the metaverse is also a social space formed by humans in the real world, the basic rights to be recognized and protected by humans in the real world should be confirmed and respected in the metaverse, and the criminal policy direction for the metaverse is here. In the metaverse, the legal system of reality rules centered on physical entities cannot directly operate. However, if we can ‘recognize’ reality-like entities in the metaverse, norms and legal systems that can respect and protect recognized values and meanings must be established. ‘Cyber personality right’, which is proposed in this article to prepare the criminal policy direction in the metaverse, can be said to be the basic concept for preparing such a normative system.

The development of Artificial Intelligence(AI) has been accompanied by or preceded by advances in technology for collecting and processing big data, and thus inevitably raises various concerns surrounding the personal information processing. In particular, the personal information processing in criminal proceedings was one of the most important topics even before the use of AI. Therefore, it is necessary to review what kind of legal evaluation the personal information processing to which AI is applied will undergo throughout the criminal proceedings, such as criminal investigation by investigative agencies or evidence investigation by courts, and what kind of changes it will cause. Therefore, this study examines the AI investigators who discovered illegal loan business, which was reported as the first case where AI was introduced in the process of criminal investigation in Korea and the Personal Information Protection Committee’s decision to violate the γPersonal Information Protection Actγ. Through the above case, it was considered what technical and normative elements should be considered when AI based on personal information utilization is used for criminal investigation purposes. Also, we would like to introduce the γArtificial Intelligence Act(draft)γ announced by the European Union on April 21, 2021 as a reference standard in Korea. In addition, it will be reviewed γAct on the Performance of duties by Police Officersγ amended in 2020 can function as a basis for processing personal information for criminal investigation and prevention purposes.

Information and communication technologies enable new digital-based products or services to be launched. The advanced technologies leading the 4th industrial revolution are also based on the development of ICT. Artificial intelligence which is synonymous with cutting-edge technology, autonomous vehicles and drones to which the technology is applied, internet of things and encryption/anonymization technologies, that are leading network innovation in terms of network expansion and security enhancement, and extended reality and digital manufacturing technology, which are leading the convergence of the digital world and the physical world, are all based on ICT. The development of high technology can make human life more convenient and affluent, but if the technology is abused for crime, it can threaten the safety of society and maintaining order. The state may prepare laws to regulate crimes using advanced technology, but if the measures are not taken promptly, even if there is a result infringing on the interests of the law, the perpetrators cannot be punished because there are no regulations. Today, the gap between the development of technology and the speed of related legislation is rapidly narrowing. This paper examines the types of crimes and the regulatory status of major countries for them so that appropriate regulations can be made on crimes using advanced technology, and suggests improvement plans after checking the current state of legislation in Korea.

Our life has been improved by using computers or smartphones. At the same time, however, unfortunately, virtual space has become aβbreeding groundβ for various types of crimes. With the advent of new information and communication technology, it played a positive function, but as one of its adverse functions, a new type of crime or deviant behavior emerged. As the prevalence of personal computers increased, various environments such as e-mail were established and helped spread the virus, computer viruses that did not exist in the past appeared. Among various criminal phenomena in virtual space, cyberstalking is a case in which the development of information and communication technology poses a fear of the safety of the victim’s individual. Cyberstalking perpetrators use e-mails, instant messages, blogs, chatrooms, and social networks. They torment victims ‘repeatedly and constantly’. Cyberstalking can be linked to other crimes, leading to other violent crimes such as sexual violence or murder. In 2021, the Act on the Punishment of Stalking Crimes was enacted and enforced. However, the current Act does not apply to various types of cyberstalking in virtual space. Therefore, the Act needs to be supplemented to comprehensively apply cyber stalking. Additionally, the Act for the protection of cyberstalking victims need to be enacted for the protection of rights. Therefore, in this article, I examined the concepts of stalking and cyberstalking, reviewed the current law and foreign legislation, and proposed the direction of legislative improvement.

As artificial intelligence(AI) is used in criminal justice, experts in the field of technology who value the objectivity of AI and people of color who have been victims of discriminatory judicial judgments have shown a preference for judicial decisions of AI over human judges. However, the data that AI learns through machine learning is nothing more than a collection of past law enforcement records. In other words, it is data that reflects the prejudice and discrimination of the past. AI learned from such data is difficult to derive fair prediction results. Therefore, using the output as it is without making any corrections poses a risk of doing great injustice under the guise of technical, objective, and neutral science. The European Parliament’s Resolution 2020/2016(INI) of October 2021 is located at this point. It insisted that the decisions made by AI should not be used as it is in criminal matters until it can be trusted that AI with transparency and accountability does not harm the fundamental rights of citizens. Above all, EU citizens have the’right not to be subject to decisions based solely on automated processing’by GDPR Article 22 and Law Enforcement Directive Article 11. This resolution of the European Parliament has a special legal character reaffirming this right in the field of criminal justice. However, in the long term, it is expected that the number of cases of AI support in the criminal justice system will increase due to lack of budget, human resources and delayed cases. So, what position should we take on the hybrid decision of machines and humans? The European Union is reluctant to follow the past cases that triggered legal and ethical problems with AI by entrusting it to self-regulation by private companies. They seek to protect the fundamental rights of citizens and align with the ideals of criminal justice by strengthening the transparency and accountability of AI through public intervention. The European Parliament resolution 2020/2016(INI) of October 2021 is a noteworthy document that sets out such a goal in the field of criminal justice.

The current sentencing standards do not set the sentencing standards for fines. Due to the lack of sentencing standards for fines, problems such as imbalance and unfairness of sentencing and lack of predictability of sentencing are occurring. This paper presents a basic model for the penalty sentencing criteria. This paper presents a model (1 model) for selecting the recommended area after determining the recommended area and a model (2 model) for determining the recommended area after selecting the type. After reviewing the model for selecting the type, it was proposed as follows. It is reasonable to apply the fine sentencing standard only when the fine is legal as an optional sentence, and it is reasonable not to apply the fine sentencing standard if the fine is a combination sentence. The common principle of type selection needs to be set as a standard that can be applied not only to individual crime groups but also to all crime groups. Selection factors for selection of types from individual crime groups should be extracted.

The practice of unconditional termination of investigations following the suspect’s death needs to be reviewed in that it fails to fulfill its obligation to discover substantive truth; it weakens the utility of internal investigation and investigation; and furthermore, it fails to guarantee the rights of victims, and makes it difficult to recover victims’ damage. Recognizing the problems of ceasing investigation due to the suspect’s death, this paper suggests practical improvement measures such as the victim’s right to review in UK; revision of police investigation rules; and activation of the police investigation review committee. In the internal investigation stage, it should be conducted only for the purpose of determining the presence or absence of criminal charges; In the investigation stage, specifically, it should be continued in the following restrictive situations 1) the criminal facts are needed for further investigation, 2) secondary victimization is sufficiently foreseeable, and 3) the victim or suspect requests disclosure of the investigation. Continuing an internal investigation or investigation while the victim is solely alive cannot avoid criticism arising from the equity issue in that the suspect’s right to defend is not guaranteed. It is solely the role of the agency, however, to investigate with fairness: and the damage caused by this should not occur to the victim. It should be free from controversy over equity when the investigation continues while the suspect is deceased. At the same time, the role of investigative agencies to guarantee the rights of victims should be redefined as well.
