미국은 연방과 주(state)별로 각각 검사제도가 확립되어 있으며, 연방과 주 모두 법무장관이 검찰총장을 겸한다. 연방법무부장관(US Attorney General)은 대통령이 임면권을 갖고 있으며, 별도의 임기가 없고 언제든 대통령이 해임할 수 있다. 주의 경우 대부분 주법무부장관(Sate Attorney General)은 주민에 의해 선출되며, 일정한 임기가 정해져 있고, 주지사는 법무부장관의 임면에 관여하지 않는다. 주지방검찰청(카운티검찰청)의 지방검사장 또는 지방검사(district attorney)도 독립성이 보장되어 있다. 검찰과 검찰총장의 정치적 독립성은 공소권의 독립성(prosecutorial independence)이라는 관점에서 필히 요청되는 것이다. 그러나, 미국에서도 연방법무부장관의 독립성은 계속해서 문제가 되고 있다. 미국 연방법무부장관이 정치화된 것은, 결국 대통령이 해임을 자유로이 할 수 있기 때문이다. 미국의 각 주의 지방검사(District Attorney)가 독립적인 것은 대개 유권자에 의해 선출되기 때문이다. 여기에서 우리는 검찰총장의 선출직화도 생각해 볼 필요가 있다. 국민이 사법절차에 참여하는 것은 관련 사법기관에 민주적 정당성을 부여함으로써 기관의 중립성과 독립성을 보장하는 방안이 될 수 있다. 임명권자로부터의 독립이라는 관점에서 기존 제도의 보완을 위한 노력이 필요할 것이다. 그 방안의 하나로 검찰총장의 임명에 국회의 동의를 필수 요건으로 하여 민주적 정당성을 부여함으로써 검찰총장의 독립성을 강화하는 방법도 있을 것이다. 우리나라나 미국 모두 초기에 검사는 법관에 준하는 준사법기관(quasi-judicial officer)으로 이해되었고, 검찰 독립의 의미는 사법부의 독립에 준하는 것이었다. 우리나라나 미국 모두 형식상 검찰총장과 검사가 행정부 소속으로 되어 있으나, 여전히 준사법기관으로 파악되어야 하고, 공소권의 독립을 위해 검찰총장과 검찰조직의 독립성과 정치적 중립성은 당연한 규범이라 할 것이다. 검찰은 사법기능의 일부를 수행하는 준사법기관으로서 사법부 독립에 준하는 독립성과 정치적 중립성의 보장이 요청된다는 점을 유념해야 할 것이며, 이를 위해서 검찰 밖과 안에서 동시적인 노력이 필요할 것이다. 본 논문은 검찰의 정치적 중립성과 관련하여 미국의 검찰제도의 연혁과 검찰조직을 살펴보고, 검찰총장을 겸하는 미국 연방법무부장관의 정치적 중립성을 고찰한 후, 우리에게 주는 시사점을 생각해본 것이다.
The U.S. has a federal and state-by-state public prosecution system. Both the US and State Attorney General concurrently serves as a prosecutor general. The US President has the right of appointment for the US Attorney General who is subject to removal by the president. The US Attorney General has no fixed term of office and can be dismissed by the president at any time. In the case of states, most State Attorney Generals are elected by residents, with a fixed term of office, and the governor cannot involve in the appointment or dismissal of the State Attorney General. The District Attorney is elected by local residents, and also guaranteed independence. The political independence of the public prosecution and the prosecutor general is necessarily required from the perspective of the prosecutorial independence. However, even in the United States, the independence of the US Attorney General continues to be a controversial issue. The reason why the US Attorney General has been politicized is that the president is free to dismiss him after all. The District Attorney in each state of the United States is independent because he is usually elected by residents. Here, we also need to think about the direct or indirect election system of the prosecutor general. The people’s participation in the judicial procedures can be a measure to ensure the neutrality and independence of the public prosecution. Efforts will be needed to supplement the existing system from the perspective of the US Attorney General’s independence from the President’s power to appoint. One of the measures would be to strengthen the prosecutor general’s independence by giving him democratic legitimacy by requiring the parliamentary consent for the appointment of the US Attorney General. In both Korea and the United States, prosecutors were initially regarded as quasi-judicial officers equivalent to judges, and the meaning of prosecutorial independence was equivalent to that of the judiciary. Both in Korea and the U.S. the prosecutors and the prosecutor general are formally affiliated with the administration, but they should still be identified as quasi-judicial officers, and the independence and political neutrality of the prosecutor general and the prosecution’s office essential for the independence of the right to indict. The prosecution should keep in mind that as a quasi-judicial body it is required to ensure independence and political neutrality equivalent to judicial independence. With regard to the political neutrality of the prosecution, this paper examines the history of the prosecution system in the United States and the political neutrality of the US Attorney General, who also serves as the prosecutor general, and then considers the implications for the improvement of the prosecution system of Korea.
